DEVAN RAMACHANDRAN, M. B. SNEHALATHA
Prasad – Appellant
Versus
Greeshma – Respondent
Key Points: - The Family Court directed the return of 53 sovereigns of gold ornaments to the respondent; appeal allowed in part. (!) (!) (!) - The 2nd respondent (mother-in-law) is held liable to return 53 sovereigns of gold to the petitioner. (!) - The judgment emphasizes a pragmatic, preponderance-of-probabilities approach to entrustment due to the informal, domestic nature of such transactions. (!) (!) - The petitioner’s entrustment case is supported by Ext.P2 (bills) and Ext.P3 (photographs), establishing 53 sovereigns were purchased and worn on the wedding day. (!) - Petitioner's entitlement is specifically for 53 sovereigns of gold ornaments entrusted to the 2nd respondent for safekeeping; the 1st respondent’s entitlement is not established. (!) (!) - The petitioner originally sought return of 81 sovereigns; evidence led to a determination of 53 sovereigns being entrusted and recoverable. (!) (!)
