Heard Mr. P. Sajan Kumar, learned counsel for the petitioner - judgment debtor No 3.
2. This revision is filed under Section - 227 of the Constitution of India challenging the registration of EP and the consequential attachment order dated 25.02.2025 passed in ARB E.P. No.49 of 2024 in Arbitration Case ARB No.880 of 2014 by I Additional District Judge at Karimnagar.
3. Perusal of record would reveal that on the application filed by respondent No.1 vide Arbitration Case ARB No.880 of 2014, the Chit Arbitrator/Deputy Registrar of Chits, Karimnagar, had passed an award dated 29.11.2014 directing the petitioner herein and respondent Nos.2 and 3 to pay an amount of Rs.5,93,268/- along with interest @ 10% per annum from the date of petition i.e., 26.03.2014 till the date of Award and @ 18% per annum from the date of award till realization. They shall also pay Rs.21,450/- towards costs of the arbitration proceedings.
4. Pursuant to the said award, respondent No.1 herein had filed an execution petition vide E.P. No.49 of 2024 in ARB No.880 of 2014 against the petitioner herein for recovery of Rs.16,30,422/- from him. Vide the aforesaid order, learned I Additional Distric
Execution of arbitration awards must adhere to procedural rules, ensuring fair treatment of all judgment debtors and allowing the decree holder options for recovery.
The Executing Court must adhere to procedural requirements in execution proceedings, ensuring proper notice and opportunity for judgment debtors, particularly regarding the liability of sureties.
The liability of co-sureties is co-extensive with that of the principal debtor, allowing the decree holder to recover the awarded amount from any or all judgment debtors.
The liability of co-sureties is co-extensive with that of the principal debtor unless otherwise provided by contract, allowing the decree holder to recover from any or all judgment debtors.
The execution of an arbitral award must proportionately consider the liabilities of co-sureties and cannot impose total deductions from salaries.
Decree-holders must adhere to the awarded amount in recovery proceedings against co-sureties under the Chit Fund and Contract Acts, prohibiting excess recovery.
