JUDGMENT
Simpson, A J C - This is an application under Section 115 of the Civil P.C. in revision. The order is one passed by the learned Additional Judge of Gonda, making a decree in terms of an award by four arbitrators. There was a suit and there was an application to have it referred to the arbitration of four persons. The arbitrators filed an unanimous award and the decree is in accordance with the award. The objection taken is that the arbitrators relied on their own knowledge and did not take evidence. The learned Subordinate Judge has found that this is what the parties intended should happen. Three of the arbitrators selected were witnesses in the case and the fourth arbitrator has stated that he had personal knowledge of the case. It further appears that the parties intentionally abstained from producing any evidence before the arbitrators. There is no ground for revision here. The application is dismissed with costs.
