1932 Supreme(Oudh) 54

HIGH COURT OF OUDH
Raza, J.
Sheomangal Prasad - Appellant
Versus
Durga Sahai Shukul - Respondent
Decided On : 12-12-1932

JUDGMENT

Raza, J - These are applications under Section 25, Provincial Small Cause Courts Act (Nos. 101 and 102). I have examined the records and heard the applicants' learned Counsel. In my opinion there is no substance in these revisions. It should be borne in mind that Section 25, Small Cause Courts Act, does not give any right of appeal on law or fact and the powers conferred by the section are purely discretionary and not to be exercised unless it appears that some substantial injustice has resulted from the decree of the Court of Small Causes: see Raghuraj Singh v. Saheb Din, (1912) 15 OC 319. In my opinion no substantial injustice is established in these cases. Hence I dismiss the applications.
