ORDER:
Accused No.7 preferred this Criminal Revision Case under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.) impugning the order dated 24.01.2023 of learned Principal Junior Civil Judge-cum-XI Additional Metropolitan Magistrate, Gannavaram in Crl.M.P.No.1491 of 2016 in C.C.No.08 of 2017 whereby and whereunder the learned trial Court refused to discharge him from C.C.No.08 of 2017. Respondent No.1 is the State. Respondent No.2 is the de facto complainant.
2. Sri Alla Malleswara Rao lodged a written information on 20.10.2008. Upon which, the Station House Officer, Gannavaram, Vijayawada registered F.I.R.No.275 of 2008. The Sub-Inspector of Police investigated the case and filed the charge sheet before the learned Magistrate arraigning accused Nos.1 to 10 and that became C.C.No.08 of 2017. Cognizance was taken by the learned Magistrate and process was issued. The offences alleged in the charge sheet are Sections 465, 468 and 420 read with 34 I.P.C. This being a case instituted on a police report governed by Chapter XIX of Cr.P.C. requiring procedure prescribed for trial on warrant cases the trial Court was obliged to comply with Sections 239 and 240 of Cr.P.C. and accord
