ORDER

1. The SWP/WP(C) No. 612/2009 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as T.A. No. 61/79/2023 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court with following prayer:

a) “to quash Order dated 1^st September, 2008 issued by Divisional Commercial Manager, Ferozpur, respondent no. 3 by which respondent no. 3 has imposed punishment of reduction of lower stage in time scale, i.e., reduction of pay from Rs. 6050 to 5600 for the period up to 31^st December, 2008, the date the petitioner is superannuated and to quash the charges framed against the petitioner and also to quash the proceedings of departmental inquiry conducted against the petitioner, by issuance of writ of certiorari;

b) to issue directions to the respondents to fix the pension of the petitioner on the basis of the last pay drawn without reducing the pay of the petitioner and also to pay arrears of the pay of the petitioner from the date the pay has been reduced, by issuance of writ of mandamus;

c) to issue directions to the respondents to promote the petitioner to the post of Deputy Ch
