1. By this writ petition, Petitioner assails the enquiry report dated 31.08.2021, penalty order dated 20.10.2021 as well as order of the Appellate Authority dated 29.11.2022 and the Review Order dated 12.09.2023. Writ of Mandamus is sought for a direction to the Respondent to reinstate the Petitioner in service with all consequential benefits including back wages, etc.
2. Facts to the extent necessary, shorn of unnecessary details and as averred in the writ petition are that on qualifying the competitive examination, Petitioner was appointed as Management Trainee on 23.12.2013 with the Respondent. Between 2013 to 2016 Petitioner worked as Scale-I Officer in Rural Branch of the Bank at Gautam Budh Nagar and was posted on 01.07.2016 at Branch Office Chander Nagar. On 04.05.2019, Petitioner was promoted in Scale-II and posted at Navyug Market.
3. Petitioner was placed under suspension on 18.02.2020 in contemplation of a disciplinary inquiry but the suspension was revoked on 23.03.2020. While the Petitioner was posted as Scale-II Officer, major penalty chargesheet dated 20.07.2020 was issued from Circle Office, Ghaziabad by Chief Manager (HRD) on 29.08.202
