IN THE HIGH COURT OF KARNATAKA AT BENGALURU
Anu Sivaraman, Vijaykumar A. Patil, JJ
KOTA PADMANABH SHENOY – Appellant
Versus
NILL – Respondent
MISCELLANEOUS FIRST APPEAL NO. 593 OF 2024 (ISA)|MISCELLANEOUS FIRST APPEAL NO. 552 OF 2024 (ISA)

Advocates:
For the Appellants/Petitioners: Arun Kumar K, Sundara Raman M.V
For the Respondents:

The question of title to the property is alien to proceedings under the Indian Succession Act; a Testamentary Court cannot reject an application for Letters of Administration solely on the ground that title deeds were not produced.

Headnote:The appellants filed petitions under Sections 220, 234, 278 and Part IX of the Indian Succession Act, 1925, for the grant of Letters of Administration regarding the estates of their deceased parents. The trial court rejected the petitions on the ground that the appellants failed to produce documents establishing that the schedule properties stood in the name of the deceased. The High Court found that the trial court's insistence on proof of title was unsustainable. The primary issue is whether a Testamentary Court is required to examine the title to the properties for which Letters of Administration are sought. The court reasoned that the Indian Succession Act is a self-contained Code and, relying on established precedents, held that the question of title or the existence of the property is immaterial in probate proceedings; the court's focus is solely on whether the applicant is entitled to the grant based on the law of succession. The Appeals are allowed
