The execution of a partition decree is valid even against deceased parties if substantial representation occurred, ensuring their interests were considered during proceedings.

Headnote:(A) Code of Civil Procedure, 1908 - Section 115, Order XXI Rule 22 - Partition Suit - Execution petition challenged on grounds of maintainability due to decrees against deceased parties - Court held process of hearing complete with representation prior to death - Doctrine of Substantial Representation applied, rejecting claims of non-impleadment of legal heirs as fatal - Court emphasized that both preliminary and final decrees had reached finality without contest from the deceased parties' representatives, legitimizing the execution process despite pending appeals. (Paras 51, 54, 56, 58)

Facts of the case:
The petitioners sought to set aside the execution order for a partition decree from 1983, claiming it was invalid against deceased parties, citing non-impleadment of their legal heirs and pending appeals related to the final decree.

Findings of Court:
The execution court concluded that substantial representation existed since the deceased parties had counsel during prior proceedings, thus justifying the execution order.

Issues: The primary questions involved whether the execution petition was maintainable against deceased parties without their legal heirs and if the appeal's pendency should have delayed execution.

Ratio Decidendi: The court ruled that the legal framework permitted execution despite the absence of certain legal heirs, as their interests were represented adequately prior to their death, and the execution was timely and equitable.

Result: Civil Revision Petition dismissed.

ORDER

Aggrieved by the order in and by which the execution petition was ordered in favour of the execution petitioners, who were defendants in the original suit, some of the other defendants have filed the present revision petition seeking to set aside the said order directing execution.

2. The short facts leading to the filing of the present revision are as under:-

-

A suit in O.S. No.55/1977 was filed for partition in which a preliminary decree came to be passed on 21.5.1983 against which some of the defendants filed appeal in A.S. No.138/1983 and the said appeal was dismissed vide judgment and decree dated 30.4.1991, which resulted in the filing of the petition for final decree before the Court in which an Court Commissioner was appointed to file a report along with a sketch with regard to the suit property and on the basis of the report and sketch filed by the Court Commissioner, the final decree came to be passed in which the petitioners in the execution petition, on the basis of Exs.C-1, C-7 and C-9, viz., Plan-1, Plan-6 and Plan-8, were allotted 22 cents in the 6th plot; 66 cents in 2nd plot and 40 cents in the 7th plot with a direction to hand over the said lands to the execution petitioners.

3. Basing the claim on the said final decree, the execution petition was filed by the petitioners claiming execution of the said decree and for a direction to hand over the lands on the basis of Exs.C-1, C-7 and C-9, viz., Plan-1, Plan-6 and Plan-8, to the extent of 22 cents in the 6th plot; 66 cents in 2nd plot and 40 cents in the 7th plot to the execution petitioners.

4. The said execution petition was contested by the revision petitioners herein contending that the execution petition is not maintainable as the said execution petition has been filed against dead person. Further, it was contested that the appeal as against the final decree is pending and that the execution petition has been filed beyond the period of two years, in which case, notice has to be issued as mandated under Order XXI Rule 22 of the Code of Civil Procedure and as no notice has been issued it is clear infraction of the mandate under the and, therefore, the execution petition deserves to be dismissed.

-

5. Considering the aforesaid contentions, the executing court held that before final decree was passed, the respective defendants were heard through their counsel and only after the arguments were heard, the defendants had passed away and, therefore, no prejudice was caused to the case of the defendants. The execution court further held that the defendants, who had raised the plea of maintainability were in fact siblings and the passing away of one of the siblings was very well within the knowledge of the siblings, yet they had neither brought it to the notice of the court nor taken any steps to array the legal heirs of the said dead persons as party defendants which clearly shows that the present petition is only an attempt to drag the proceedings to frustrate the final decree as there was substantial representation fulfilling the Doctrine of Substantial Representation. The execution court further held that the majority of the defendants, viz., more than two-thirds had accepted the court commissioner’s report and had accepted their share and merely because some of the defendants had raised a plea that proper partition has not been made cannot be a case to drag on the proceedings, which has been continued for more than four decades. The execution court further held that in the appeal filed in A.S. No.120/2014 against the final decree proceedings, though it is claimed that many persons had died, yet they are not represented by impleading their legal heirs, and in A.S. No.120/2014, the revision petitioners herein have merely mentioned the dead persons, as parties to the said suit and, therefore, the contention of the revision petitioners that the execution petition is not maintainable against dead persons cannot be sustained. On the above reasoning, the executi
