1. This Appeal is filed under section 19 of the Consumer Protection Act, 1986 (“the Act”), against the State Consumer Disputes Redressal Commission, Chhatisgarh at Raipur (“State Commission”) Order dated 14.07.2016 in CC No. 13 of 2016, wherein the State Commission dismissed the complaint filed by the Complainant.
2. As per the Registry report, there is a delay of 3 days in filing the present Appeal and in the interest of justice, the delay is condoned.
3. Brief facts of the case, as per the complainant, are that the Opposite Party (OP) is in the business of giving loan and receives interest from the customers. The Complainant applied for mortgage loan from OP, and the OP approved loan of Rs. 1,00,50,000 on 31.03.2013; Rs.50,00,000on 31.03.2013 and Rs.1,50,00,000 on 10.09.2014 vide Loan Account Nos. HLAPRPR 00157688, HLAPRPR 00162724, HLAPRPR 00162724 respectively. The Complainant is in the business of trading of clothes/business only and the said trade/business is the only source of livelihood of the complainant and thus the complainant is the consumer of the OP.
