MUHAMMAD NAZRIN AYAN – Appellant

[1] After a full trial, the appellant was convicted on a charge of self- administration of drugs under s 15(1)(a) of the Dangerous Drugs Act 1952 , read together with s 39C(1)(b).
[2] The charge was framed in the following manner:
"... Bahawa kamu, pada 23 Mei 2019, jam lebih kurang 0150 hrs, bertempat di Pejabat Bahagian Siasatan Narkotik IPD Tawau, di dalam Daerah Tawau, di dalam Negeri Sabah, didapati kamu memberikan kepada diri sendiri Amphetamine dan Methamphetamine ke dalam badan kamu sendiri. Oleh itu kamu telah melakukan satu kesalahan di bawah s 15(1)(a) Akta Akta Dadah Berbahaya 1952 dan dibaca bersama s 39C(1)(b) Akta Dadah Berbahaya 1952, kerana mempunyai (2) sabitan lampau di bawah s 15(1)(a) Akta Dadah Berbahaya 1952. Oleh yang demikian, kamu boleh dihukum di bawah s 39C(1) Akta Dadah yang Berbahaya yang membawa kepada penalti yang lebih berat."
[3] Section 39C (1)(b) provides for enhanced punishment for habitual offenders under s 15(1)(a), such as the appellant who has two previous convictions. It provides for a sentence of imprisonment for up to 7 years and 3 strokes of the cane.
