2019 MarsdenLR 3727
HIGH COURT MALAYA KUALA LUMPUR
PATRICIA SUE LIN KNUDSEN – Appellant
Versus
JOEY JAMES GHAZLAN – Respondent
[Originalting Summon No: WA-24F-215-08/2018]
Welfare of the child is paramount in custody and guardianship decisions, overriding the presumption favoring the mother in illegitimate child cases.
Headnote:The present application involves the custody and guardianship of an illegitimate child under the applicable statutes including the Guardianship of Infants Act 1961 and English common law. The court found the welfare of the child to be paramount, dismissing the plaintiff's application citing her unfitness and the child's best interests as decisive factors. It was held that the child could not be placed in the care of the mother due to factors impacting her stability and wellbeing.
