Compounding of offences under the Penal Code is permissible at the appellate stage, balancing individual circumstances and public interest in sentencing.

Headnote:(A) Penal Code - Sections 323 and 326A - Criminal Procedure Code - Section 260 - Charges for causing harm to spouse - Appellant charged for intentionally causing injury to spouse - Court allowed compounding of the offence during appeal and ordered compensation of RM8000.00 - The incident arose from an altercation over household issues, resulting in the complainant suffering soft tissue injuries. (B) Compounding Offences - A compoundable offence under the Penal Code may be compounded by consent of the Court, even at the appeal stage, as an appeal is a continuation of trial. (Paras 13, 16)

(C) Sentencing - The court should consider the individual circumstances and the public interest in sentencing, and should weigh the facts carefully before making a decision on punishment. (Paras 7, 12, 19)

Facts of the case:
The appellant was charged with causing injuries to his wife during a domestic dispute, with specific reference to the events leading to the assault.

Findings of Court:
The impugned conviction was compounded with consent from the complainant, leading to a monetary compensation instead of imprisonment.

Aslam Zainuddin J:

[1] The appellant was arraigned in the Magistrates' Court Ampang on a charge as follows:

"Bahawa kamu pada 13 September 2020 jam lebih kurang 12 tengahari, di alamat No 65 Tingkat 4, Blok Maya, Astaria Apartment, Taman Kosas, 68000 Ampang Selangor di daerah Hulu Langat, di dalam Negeri Selangor Darul Ehsan didapati telah dengan sengaja mendatangkan kecederaan kepada penama Nazla binti Hamzah, K/P: 790410-14-5720, umur 41 tahun yang merupakan isteri kamu. Oleh yang demikian, kamu telah melakukan suatu kesalahan yang boleh dihukum di bawah s 323 Kanun Keseksaan dibaca bersama s 326A Kanun Keseksaan".

[2] In the Court below, after a full trial the appellant was found guilty and sentenced to ten months imprisonment. On appeal to the High Court, after due consideration I consented for the offence to be compounded under s 260 of the Criminal Procedure Code by the complainant who was present in person and ordered the appellant to pay RM8000.00 to the complainant as compensation. My reasons are as below.

[3] But first let me set out the facts of the case briefly as gleaned from the judgment of the Court below:

"OKT dan SP1 (mangsa) merupakan sepasang suami isteri yang telah berkahwin pada 25 Disember 2004, mempunyai 3 orang anak dan mereka tinggal bersama di rumah alamat No 65, tingkat 4, Blok Maya, Astaria Apartment, Taman Kosas, 68000 Ampang, Selangor.

Kejadian yang dikatakan berlaku pada 12 September 2020, jam lebih kurang 7 petang, dimana SP1 telah memberitahu OKT tentang bumbung kereta SP1 yang kebocoran dan meminta OKT sedikit wang untuk membaiki kereta tersebut.

OKT telah memarahi SP1 dan satu pertengkaran kecil berlaku antara OKT dan SP1.

Keesokkanya pada 13 September 2020, jam lebih kurang 12 tengahari, SP1 sedang membuang bulu kucing yang melekat pada pakaian sebelum dicuci, tetapi dimarahi oleh OKT yang mengatakan perbuatan SP1 membuang bulu kucing adalah sia-sia dan membuang masa.

OKT kemudiannya bertindak memukul kepala SP1 dan menumbuk bahu SP1, seterusnya menolak SP1 sehingga terjatuh ke dalam bilik air.

Selepas itu OKT mengambil kasut dari luar rumah dan memakai kasut tersebut di dalam rumah. SP1 telah menegur perbuatan OKT ini dan OKT bertindak menendang SP1 di bahagian belakang badan sehingga SP1 jatuh ke atas kerusi di ruang tamu.

Semasa kejadian, kawan SP1 iaitu SP2 ada di rumah OKT, di dalam bilik bersama anak-anak pengadu dan OKT. SP2 telah mendengar pengadu menjerit dan meminta tolong, lalu SP2 keluar melihat dan cuba meminta OKT berhenti tetapi takut akan keselamatannya sendiri, SP2 masuk semula ke bilik.

SP1 telah membuat laporan polis sepertimana di exhibit P4 dan sepasukan anggota polis diketuai P5 telah pergi ke tempat kejadian dan menahan OKT.

SP1 telah mendapatkan pemeriksaan dan rawatan di Jabatan Kecemasan Hospital Ampang, di mana telah disahkan SP1 mengalami soft tissue injury secondary alleged assaulted by husband".

The Law

[4] The Penal Code provides:

4.1 Punishment for voluntarily causing hurt

323. Whoever, except in the case provided for by s 334, voluntarily causes hurt, shall be punished with imprisonment for a term which may extend to one year or with fine which may extend to two thousand ringgit or with both.

4.2 Punishment for causing hurt to spouse, former spouse, etc.

326A. (1) Whoever causes hurt to his spouse or former spouse, a child, an incapacitated adult or other member of the family and commits an offence under ss 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term which may extend to twice of the maximum term for which he would have been liable on conviction fo
