2013 0 Supreme(P&H) 1182 : Under the Punjab Security of Land Tenures Act, a landlord can file a petition for the execution of a qabuliatnama and for the determination of rent (including enhancement to one-third batai) without needing to first file a separate suit under the Punjab Tenancy Act. The court held that the power to eject a tenant under Section 9(1)(vii) of the Punjab Security of Land Tenures Act inherently includes the power to fix the rent at a rate not exceeding one-third batai, as permitted under Section 12 of the Act. This determination can be made in the same proceeding, and separate proceedings under the Punjab Tenancy Act are not required. 1961 0 Supreme(P&H) 209 : Yes, a landowner can file a suit for enhancement of rent against a tenant under both the Punjab Tenancy Act and the Punjab Security of Land Tenures Act. Under Section 70 of the Punjab Tenancy Act, the Court can determine compensation to be paid to the tenant for improvements or for disturbance when decrees for ejectment of the tenant or for enhancement of rent are passed.
