Shared Household - Definition and Rights
The Act defines shared household under Section 2(s) as a household where the woman has lived or currently lives, or has a right to reside in, regardless of ownership or title. It is not limited to self-acquired property but extends to households where the woman has a domestic relationship (Section 2(f)) NEETU RANA VS STATE OF U. P. - Allahabad.
However, in cases involving joint family or property of a Hindu undivided family, courts have held that such property may not qualify as a shared household unless the woman has a right to reside there (Section 19) Urmila VS Ramesh Chander - Punjab and Haryana.
Right to Reside in Shared Household
Under Sections 17 and 19(1), women in a domestic relationship have a statutory right to reside in the shared household, which can be exercised even against family members like father-in-law or husband, subject to certain conditions. This right is independent of ownership and aims to protect women from eviction or harassment Sangeeta VS Om Parkash Balyan - Punjab and Haryana, Yama VS Ankit Manubhai Patel - Crimes.
Notably, this right is available even if the woman is not an owner or has no legal title to the property, emphasizing the protective intent of the law NEETU RANA VS STATE OF U. P. - Allahabad.
Protection Orders and Relief
The Act empowers courts to issue protection orders, including residence orders, monetary compensation, and other reliefs, to safeguard women from domestic violence within the shared household Jyoti Parihar VS Munindra Singh Parihar - Madhya Pradesh, Rupinder Kaur VS Harjinder Kaur - Punjab and Haryana.
Application under Section 12 for residence rights can be made without the need for a report from protection officers, and such applications are maintainable even if the respondent is not personally served or present Anil VS Sudesh - Punjab and Haryana.
Limitations and Conditions
Violence must occur within the shared household to constitute domestic violence under the Act. Violence committed outside or in separate households does not qualify Om Parkash Syngal VS Aditi Garg - Punjab and Haryana.
The law also clarifies that a woman’s right to reside does not extend to joint property of a Hindu undivided family unless she has a specific right to reside there Urmila VS Ramesh Chander - Punjab and Haryana.
Legal Proceedings and Evidence
Complaints under Section 12 can be filed and pursued through legal proceedings without the need for the woman to appear personally at every hearing, provided she is represented by counsel Rupinder Kaur VS Harjinder Kaur - Punjab and Haryana.
The definition of domestic relationship and shared household is crucial in determining the applicability of the Act, and courts examine evidence to establish the domestic relationship and residence rights Preeti w/o Manoj Badoniya VS Neha W/o Rohit Ujjaini - Madhya Pradesh.
The Protection of Women from Domestic Violence Act recognizes shared household as a central element in safeguarding women's rights to residence and protection within a domestic setting. The law broadens the scope beyond ownership, emphasizing the woman's right to reside in households where she has lived or has a right to live, regardless of property titles. Courts have consistently upheld women's rights to reside in shared households, even against family members like in-laws, provided the criteria are met.
However, the Act's protections are confined to violence occurring within the shared household, and property of joint or family ownership may not automatically qualify unless the woman has a legal right to reside there. Legal proceedings are accessible and designed to facilitate women's protection without onerous procedural requirements.
