Judgment

SIKRI, CJI.: - In this petition under Article 32 of the Constitution the petitioner complains against his detention. The relevant facts are these. It appears that the petitioner was arrested on January 10, 1968 but it is not quite clear by whom he was arrested. The suggestion of the State Counsel is that he was arrested originally under the Armed Forces (Assam and Manipur) Special Power Act, 1958. Be that as it may, according to the affidavit of Shri P. Sengupta, Deputy Secretary to the Government of Assam Political (A) Department, he was arrested by the Civil Police on January 24, 1968, and was produced before the competent Magistrate on January 25, 1968, in connection with G. R. Case No. 27/68. It is further stated that the Civil Police registered other cases against the petitioner vide G. R. 235/68 of Aijal Police Station Case No. 16 (8)/ 68 under Section 32 (5), D. I. R., G. R. 212/66 of Aijal Police Station Case No. 54 (5) 166 under Section 121, Indian Penal Code., etc., and G. R. Case No. 27/68 vide Session Case No. 128/69 under Section 121 (A)/392, Indian Penal Code.
