Service Law – Ex-gratia payment – Rejection of claim for grant of ex-gratia payment due to death of wife of petitioner – Wife of petitioner died on 12.05.2015 much before State Government took decision on 22.8.2015 and notified by Education Department on 08.09.2015 – Petitioner cannot claim extension of ex-gratia benefits – Petition dismissed. ORDER

Heard the parties.

2. The petitioner has prayed for quashing of the memo No 386 dated 20.04.2022 passed by the District Education Officer, Jamui by which his claim for the grant of ex-gratia payment due to death of deceased’s wife, Usha Kumari has been rejected.

3. It is an admitted fact that the wife of the petitioner, Usha Kumari died on 12.05.2015 much before the state government took the decision on 22.8.2015 and notified by the Education Department on 08.09.2015.

4. The petitioner’s wife Usha Kumari serving as Block Teacher at Middle School, Rampur under Block Sikandra in the district of Jamui, unfortunately died on 12.05.2015.

5. Subsequently, in the light of resolution no.25/2015- 21062 dated 8.9.2015 (Annexure-4 to the writ petition) issued by the Education Department, the petitioner preferred representation followed by CWJC No. 3615 of 2021 before Patna High Court.

6. A bench of this Court vide an order dated 12.8.2021 directed the respondent District Education Officer, Jamui to dispose of his representation (Annexure-5 to the writ petition).

7. Subsequently, the respondent District Education Officer, Jamui vide reasoned order/memo no. 386 dated 20.4.2022 rejected his claim (Annexure-6 to the writ petition).

Having heard learned counsel for the parties, this writ application is disposed of with a direction to the respondent no. – 2 / District Education Officer, Jamui to consider the grievance of the petitioner raised in his representation at Annexure - “7” to the writ petition and to dispose the same in accordance with law by a reasoned and speaking order within a period of two months from the date of receipt / production of a copy of this order. Needless to say that if any amount is found payable to the petitioner, the same shall be paid by the concerned respondent within a period of one month from the date of disposal of the representation.

With the aforesaid observation and direction, this writ petition is disposed of.
