2023 Supreme(Del) 1815

IN THE HIGH COURT OF DELHI AT NEW DELHI
Chandra Dhari Singh, J.
Al Amal Hajj Umra Service – Appellant
Versus
Union of India – Respondent
W.P.(C) 8411 of 2023
Decided On : 07-06-2023

Advocates appeared:
Mr. Sulaiman Mohd. Khan, Ms. Taiba Khan and Mr. Bhanu Malhotra, Advocates, for the Petitioner.
Mr. Kirtiman Singh, CGSC with Mr. Waize Ali Noor and Mr. Amit Gupta, Advocates, for the Respondent.

The main legal point established in the judgment is that the suspension of a Haj Group Organizer's Registration Certificate and Quota should not impede the religious freedoms of pilgrims, as guaranteed under Article 25 of the Constitution of India.

Headnote:

Haj Group Organizer - Suspension of Registration Certificate and Quota - Circular No.15/28/20022-Haj-MoMA dated 14th March 2023 - Article 25 of the Constitution of India

Fact of the Case:

The petitioner, a Haj Group Organizer (HGO), challenged the suspension of their Registration Certificate and Quota for Haj-2023, alleging arbitrary action by the respondent. The petitioner contended that the suspension violated their fundamental rights and jeopardized the pilgrims' once-in-a-lifetime opportunity to undertake Haj for Haj-2023.

Finding of the Court:

The Court found that while restrictions and conditions could be imposed on the issuance of Registration Certificates and Quotas to HGOs, such actions should not impede pilgrims who had registered in good faith. The Court held that the suspension of the petitioner's Registration Certificate and Quota was in derogation of Article 25 of the Constitution of India, which guarantees the freedom of conscience and the freedom to practice and propagate religion.

Issues: The issues revolved around the suspension of the petitioner's Registration Certificate and Quota, the alleged misrepresentation of facts by the petitioner, and the potential impact on the pilgrims who had booked seats with the petitioner for Haj-2023.

Ratio Decidendi: The Court's decision was based on the interpretation of Article 25 of the Constitution of India, which protects the religious freedoms of citizens. The Court emphasized that the suspension of the petitioner's Registration Certificate and Quota should not hinder the pilgrims' religious practice and held that the suspension was against the spirit of the current Haj Policy.

Final Decision: The Court stayed the comments in the consolidated list of allocation of Haj Quota for Haj-2023, ensuring that the affected pilgrims could undertake the Haj Pilgrimage without obstruction. The Court directed the respondents to proceed with the investigation and disposed of the application.
