IN THE HIGH COURT OF DELHI
Manmohan, Asha Menon, JJ.
Pradeep (SI GD) - Appellant
Versus
Union of India - Respondent
W.P.(C) 292 of 2021
Decided On : 20-04-2021

Medical board assessments for fitness in promotions are authoritative and should adhere to the prescribed medical guidelines, with LDCE standards treated similarly to direct recruitment criteria.

Headnote:(A) Recruitment Rules and Medical Examination Guidelines - W.P.

(C) 292 of 2021 - The appellant challenged the medical board's declaration of unfitness based on 'Varicose Veins' and argued for consideration under different medical standards for promotees. The court upheld the medical board's decision, affirming that standards for LDCE may equate to those for direct recruitment. (Paras 10, 11, 12, 15)

(B) Judicial Review - The court emphasized that medical boards' assessments, which reflect the unique demands of their duties, are to be preferred over contrary opinions from outside practitioners. (Paras 11, 12, 16)

Facts of the case:
The petitioner, originally selected in 2012, challenged his medical examination results while applying for a promotional role. He was declared unfit twice due to 'Varicose Veins' despite presenting alternate medical opinions post-surgery.

Findings of Court:
The court determined that the medical assessments were justified and that the standards set for LDCE applicants were appropriate.

Issues: The primary issues included the applicability of promotion standards to LDCE and the validity of the medical fitness criteria used.

Ratio Decidendi: The ruling confirmed that the medical boards’ decisions are authoritative, reinforcing that the standards for LDCE are aligned with those for direct recruitment. No improper equating with promotee standards was warranted.

Result: Petition dismissed.
