1. This petition, under Article 227 of the Constitution of India, challenges an order dated 1st April, 2022, passed by the learned Additional District & Judge ("the learned ADJ"), in Execution Petition 245/2021.
2. Execution Petition 245/2021, preferred by the respondent against the petitioner, sought execution of a judgment and decree dated 19th February, 2020, passed by the learned ADJ in CS 9831/2016 (Ishwar Industries Ltd. v. M/s Gallus Chattels Pvt. Ltd.).
3. The operative portion of the said judgment reads thus:
"(i) A decree is passed thereby the defendants are directed to handover the physical vacant possession of the suit property i.e. Block No.4 as shown in site plan (Ex.PW1/4) within 30 days to the plaintiff after removing their additions, alternations, stocks, furnitures, fixtures, fittings, constructions and i
Repeated petitions under Article 227 intended to thwart execution process are deemed frivolous; execution petition maintainable if sufficient court fees paid.
In no uncertain terms, efforts made to stultify execution proceedings and ensure that the proceedings do not continue.
The executing court is bound to execute a decree as it stands, and objections to its execution must be based on jurisdictional issues rather than claims of error in the decree's interpretation.
Executing court cannot go behind final ex-parte decree or allow new documents absent due diligence; Article 227 supervisory jurisdiction limited to grave injustice, not re-appreciation of evidence.
The court affirmed that jurisdiction and suit valuations must be based solely on amended pleadings in accordance with procedural laws, rejecting external assertions not contained in the plaint.
The executing Court cannot go behind the decree and must execute it according to its tenor, and cannot entertain objections to the decree's correctness in law or on facts, unless it is a nullity or p....
A suit which has not been properly valued and proper court fee has not been paid, can rejected in terms of Order 7 Rule 11 of CPC.
Objection to execution of decree – Running a separate miscellaneous proceeding under Section 47 of CPC is a misuse of process of court.
Unconscionable laches can bar relief in petitions under Article 227; courts will not interfere unless there are grave abuses or derelictions.
