ORDER :

1. The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”] (formerly Section 439 of the Code of Criminal Procedure, 1973 [“Cr.P.C”]) seeks regular bail in the proceedings arising from FIR No. 290/2023 dated 27th February 2023 registered under Sections 323 /367/377/34 of the Indian Penal Code, 1860 [“IPC”] and Section 6 of the Protection of Children from Sexual Offences Act, 2012 [“POCSO”] at P.S. Jahangir Puri.

2. Briefly stated, the case of the prosecution is as follows:

2.1. The present case was registered at P.S. Jahangir Puri, based on the statement of a 16-year-old victim, “D”. The victim stated that on the night of 20th/21st February, 2023, he was sitting in a park located in C-Block, Jahangir Puri, along with his friends Vansh and Piyush @ Mooli.
