ORDER
Subhra Sankar Bhatta, Judicial Member—This appeal has been preferred at the instance of the Appellant viz. Sabita Shaw who was the original Complainant before the District Consumer Disputes Redressal Commission, Kolkata Unit-II (Central) (hereinafter referred to as ‘the District Commission’ for short) assailing the impugned order dated 29.10.2021 vide order no. 3 passed by the District Commission in connection with consumer Complaint Case no. CC/332/2021 whereby Ld. District Commission was pleased to dispose of the Miscellaneous Application no. 372/2021 being not tenable. The impugned order runs as follows:—
“In view of the above discussion, we refused to grant permission to file the instant consumer complaint to this Commission and complaint should be filed at a place where the cause of action has arisen.
Thus, Miscellaneous Application being no. 372/2021 is disposed of.
In view of forgoing observation, Complai-nant’s application dated 06.09.2021 under Section 38(8) of the C.P. Act, 2019 is not tenable. Thus, MA being no. 372/2021 is disposed of.

2. Feeling aggrieved by and dissatisfied with the above order of the Ld. Commis
Bungalow Buyer’s Agreement – Direction for refund can be passed where agreement between parties has become difficult to be honoured.
Transfer Application –The District Commission is supposed to decide the complaints summarily and preferably within three months.
Revisional Jurisdiction – Concurrent decisions of District Forum & State Commission cannot be set aside by this National Commission as it cannot go into re-appreciation of evidence.
