ORDER
Kumkum Rani, President—This appeal under Section 15 of the Consumer Protection Act, 1986 has been directed against judgment and order dated 28.02.2015 passed by the District Consumer Disputes Redressal Forum, Nainital (hereinafter to be referred as the District Commission) in consumer complaint No. 75 of 2013 styled as Sh. Nandan Singh Nayal Vs. The Branch Manager, L.I.C. of India and Anr., wherein and whereby the complaint was allowed directing the opposite parties to pay Rs.40,000/- as major surgical benefit charges alongwith interest @ 7% per annum from the date of filing of the complaint case till its actual payment together with Rs.5,000/- as litigation charges.

The facts giving rise to the present appeal, in brief, are as such that the complainant deposited a first installment premium of Rs.10,000/- with the opposite party No. 2 for getting issued a ‘Health Protection Plus Plan’ policy and after receiving the above said amount, the opposite party No. 2 issued the said policy to the complainant on dated 17.07.2009. the said policy was bearing No. 241832890; the due date of the payment of last premium of the said policy was 17.07.2025 and the major surgical benefits sum
