Twelve persons were sought to be prosecuted for the offences punishable under Sections 366A, 376 (2)(g), 511 of 376, 109 and 120B of the Indian Penal Code. Among them, the second accused absconded and eleven accused were available for trial. The first accused, who is the appellant in Crl. Appeal No.134 of 2010, was found guilty of the offence punishable under Sections 366A, 376 and 120B I.P.C. and was sentenced to undergo rigorous imprisonment for ten years and to pay a fine of Rs.10,000/-, in default of payment of which, to suffer rigorous imprisonment for three years for the offence punishable under Section 366A I.P.C. He was sentenced to undergo imprisonment for life and to pay a fine of Rs.25,000/-, in default of payment of which, to suffer rigorous imprisonment for a further period of three years for the offence under Section 376 I.P.C. and he was also sentenced to undergo rigorous imprisonment for ten years and to pay fine of Rs.10,000/-, in default of payment of which, to undergo rigorous imprisonment for two years for the offence under Section 120B I.P.C.
