JUDGMENT

1. Petitioner, Ramgopal Kumawat is a Class-IV employee (Daftary-cum-peon) employed at Ajmer Branch of the United Commercial Bank (for short the respondent Bank). He has questioned the legality of the charge-sheet dated, 30th January 1992 (Annex. 1) issued by the respondent Bank for holding an inquiry against him in respect of the allegations of misconduct enumerated in Clause 19.5 (j) and Clause 19.7 (d) of the Bipartite Settlement dated, 19.10.66 as amended.

2. Facts of the case show that the petitioner, Ramgopal was prosecuted under sections 420, 467, 468, 471 and 409 of the Indian Penal Code alongwith co-accused Har Kishan Vijayvargiya. A charge was ultimately framed against him under section 406 Indian Penal Code. The petitioner and his co-accused were tried by the Munsiff and Judicial Magistrate No. 1, Ajmer. By judgment dated, 28th May 1991 the petitioner was acquitted by the learned Munsiff and Judicial Magistrate. In the meantime, the petitioner had been placed under suspension and this suspension had continued even after his acquittal by the learned Munsiff and Judicial Magistrate. Petitioner filed writ petition No. 5969/91 before the High Court of Rajasthan at Jai
