JUDGMENT

Vinit Kumar Mathur, J. - The present second bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No.220/2018, Police Station Taranagar (Churu), for the offences under Sections 148, 364, 395, 396, 325, 302, 323, 149 of IPC.

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submits that after rejection of the first bail application on 26/08/2020, the Principal accused Rajendra Singh @ Raja has been enlarged on bail by the Coordinate Bench of this Court vide order dated 02/03/2022. He further submits that injury assigned to the deceased has been specifically attributed to Rajendra Singh @ Raja who has been enlarged on bail. Learned counsel for the petitioner submits that case of the petitioner stands on better footing as no specific injury has been attributed to the present petitioner and except the allegation in omnibus statements, there is nothing on record to connect the present petitioner in the incident, therefore, it is prayed that the petitioner may be enlarged on bail.
