2021 Supreme(Raj) 1900

RAJASTHAN HIGH COURT BENCH AT JAIPUR
Inderjeet Singh, J.
Inderjeet Singh - Appellant
Versus
The State of Rajasthan & Ors. - Respondents
S.B. Civil Writ Petition No. 23461/2018
Decided On : 05-08-2021

Advocates appeared:
Mr. R.P. Saini., for the Appellant; Mr. Avinash Choudhary For Dr. V.B. Sharma, Aag., for the Respondent.

The court established that arbitrary rejection of a candidate based on inaccurate physical measurements violates principles of fairness and due process.

Headnote:

Writ - Constable Appointment - Rajasthan Police Subordinate Service Rules, 1989 - The court emphasized the importance of accurate physical measurements and the arbitrary nature of the respondents' rejection of the petitioner's candidature, leading to a directive for reconsideration based on the Medical Board's findings.

Fact of the Case:

The petitioner, after passing the written examination for Constable (D), was rejected due to alleged insufficient height and chest measurements. The petitioner contested this decision, claiming he met the required standards as per a Medical Board's report.

Finding of the Court:

The court found that the Medical Board's report indicated the petitioner met the physical standards required for the position, thus deeming the respondents' rejection arbitrary and unjustified.

Issues: Whether the rejection of the petitioner's candidature for Constable (D) based on physical measurements was justified.

Ratio Decidendi: The court held that the Medical Board's independent assessment confirmed the petitioner met the physical requirements, rendering the respondents' decision arbitrary and necessitating reconsideration of the petitioner's application.

Result: The writ petition is allowed, directing the respondents to reconsider the petitioner's application for Constable (D) within two months.

ORDER

2. Brief facts of the case are that the petitioner participated in the selection process for appointment on the post of Constable (D) in pursuance to the advertisement dated 25.05.2018 and after having been declared successful in the written examination, the petitioner was called for physical efficiency test. However, the respondents denied the appointment on the ground that height of the petitioner is less than the required i.e. 168 cm and chest is less than the required i.e. Normal 81 cm & Expanded 86 cm. Being aggrieved by non-selection of his candidature on the post of Constable (D), the petitioner has filed the present writ petition.

    "Issue notice to the respondent(s).

Counsel for the petitioner may supply a copy of the writ petition in the office of Sh. G. S. Gill, AAG during course of the day. List this matter again on 12.11.2018 alongwith CW No. 21784/218.
