1. The present civil writ petition has been filed by the petitioners challenging the order dated 22.07.2022 passed by the Additional District Judge, Khetri, in suit No. 27/2021, whereby the application under Order 7 Rule 11 CPC moved by the petitioners has been disposed of.
2. Heard learned counsel for he petitioners.
3. Taking into consideration the facts and circumstances of the case, without interfering with the impugned order, petition filed by the petitioners is disposed of and the trial Court is directed to frame the preliminary issue with regard to objection raised by the petitioners in the application under Order 7 Rule 11 CPC and decide the same in accordance with law.
