Eligibility for medical admission no longer mandates Biology in Class 11th if completed in Class 12th as an additional subject, altering previous regulatory requirements.

ORDER :

NUPUR BHATI, J.

1. This writ petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-

“a) Qualify the Petitioner in his document verification, in view of the fact, that Petitioner has met out with all the eligible criterion and subsequently, final allotment of new college may be done qua the petitioner;

b) That petitioner's rejection of candidature by way of declaration on email as non-eligible for the said examination on the count that Petitioner has not pursued biology in Class 11th may be quashed and set aside and; further, the petitioner may be declared eligible candidate after having passed biology in Class 12th Exam as an additional subject.

c) Pass any other or further order as may be deemed just and proper in the facts and circumstances of the case.”

2. Facts of the case are that the petitioner is a meritorious student, who has successfully completed his senior secondary education by a duly recognized board, i.e., the Board of Secondary Education for Rajasthan (RBSE). The petitioner, having a strong academic inclination towards medical sciences, aspires to pursue a career as a doctor and is thus appearing for the NEET (UG) Examination for the year 2025. He completed his Class 10th education on 08.06.2017 (Annex.2) by passing the secondary examination with a total of 83.67%. Pursuant thereto, he chose science as his field in Class 11th and 12th and completed these studies in 2017–18.

2.1. Subsequently, he re-appeared for his senior secondary examination in 2019, with his mark sheet issued on 15.05.2019 (Annex.3), obtaining a total of 72.6%. He then appeared for his supplementary/additional examination in 2020; on 30.09.2020 (Annex.4), he appeared for an additional/supplementary subject of Biology and obtained First Division by securing 68 marks. Thus, the petitioner completed Class 12th in Hindi, English, Physics, Chemistry, Mathematics, and Biology, all prerequisites to appear in the NEET (UG) examinations.

2.2. In furtherance of that aspiration, he appeared for the NEET (UG) examination conducted for admission to MBBS and allied medical courses across India, fulfilling all eligibility criteria prescribed by the competent authority. He submitted his application form for NEET (UG) Examinations 2025 and received a provisional Admit Card (Annex.5) for the examination on 04.05.2025. Upon declaration of results for that exam, the petitioner’s name appeared in the merit list, i.e., the first round of provisional allotment, making him eligible to participate in the counselling and admission process conducted by the competent authorities. He obtained a percentile of 99.4359 with a total of 550 marks out of a maximum of 720. He applied under the General (EWS) category; his scorecard showing an All India Rank of 12,449 was declared on 14.06.2025 (Annex.6).

2.3. Subsequently, in the first round of provisional allotment, he was allotted Government Medical College, Barmer, on 20.08.2025 (Annex.7), but he did not choose to appear there as he preferred another college. Later, on 26.09.2025 (Annex.9), in the second round of provisional allotment, he was allotted Government Medical College, Sri Ganganagar, under the Government Category Seat. He was called for document verification to finalize his allotment, having deposited Rs.50,000/- as security on 13.08.2025 (Annex.9), without which no counselling or document verification could take place.

2.4. During the counselling and document verification process, the petitioner’s candidature was arbitrarily rejected by an email dated 01.10.2025 (Annex.10) on the ground that he had not pursued Biology as a subject in Class 11th, although he had duly studied a
