JUDGMENT :
1. Heard Mr. Anil Kumar, learned Senior counsel appearing on behalf of the petitioner along with Ms. Nalini Jha, Advocate.
2. Heard Mr. Suraj Verma, learned counsel appearing on behalf of the opposite party-State.
3. Heard Mr. Sanjay Kumar, learned counsel appearing on behalf of the opposite party No. 2.
4. This criminal revision application has been filed for setting aside the judgment dated 4th August, 2012, passed by the court of learned Additional Sessions Judge-I, Jamshedpur in Cr. Appeal No. 128 of 2010 whereby the learned Appellate Court has dismissed the appeal filed by the petitioner.
The petitioner was convicted and sentenced for the offence under Section 420 Indian Penal Code to undergo rigorous imprisonment for three years and to pay a fine of Rs. 5,000/- and in default of payment of fine, he was directed to undergo further imprisonment of two months. The order of conviction was passed by the learned Judicial Magistrate, 1st Class, at Jamshedpur, in Complaint C/1 Case No. 1128 of 2001.
