ORDER :

Prayer : Transfer CMP is filed under Section 24 of the Civil Procedure Code, to withdraw the H.M.O.P.No.78 of 2022 on the file of the Sub Ordinate Court, Gingee and transfer the same to the Family Court, Ariyalur.

The petition for transfer is filed to withdraw the H.M.O.P.No.78 of 2022 pending on the file of the Sub Ordinate Court, Gingee and transfer the same to the Family Court, Ariyalur.

2. The marriage between the petitioner and the respondent was solemnized on 10.02.2014 as per Hindu Rites and Customs. Two children were born from and out of the wedlock between the petitioner and the respondent and now they are aged about 8 and 3 years. The petitioner and the respondent are living separately on account of matrimonial dispute and the respondent/husband instituted H.M.O.P.No.78 of 2022 for divorce pending on the file of the Sub Ordinate Court, Gingee.

3. The learned counsel for the petitioner states that the petitioner is unemployed and she has to take care of her two children. Therefore, she is not in a position to spend, travel and contest the case filed by the respondent on the file of the Sub Ordinate Court, Gingee.

4. The learned counsel for the respondent raised an objec
