JUDGMENT
(Prayer: Criminal Original Petition has been filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Crime No.456 of 2022 pending on the file of the respondent police.)
1. The petitioner, who was arrested and remanded to judicial custody on 20.01.2023 for the alleged offences punishable under Sections 379, 430 of IPC, in Crime No.456 of 2022 on the file of the respondent Police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused persons had illegally transported half units of river sand in Tata Ace without having any valid permit and the said vehicle was seized by the respondent police. Hence, the complaint.
3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he has not committed any such offence as alleged by the prosecution. He further submits that the petitioner is the driver of the said vehicle and he is ready to abide by any condition as imposed by this Court and hence, he prays for grant of bail to the petitioner.
