This is a petition under Article 227 of the Constitution of India at the behest of defendant-judgment debtor for setting aside order dated 19.05.2025 (Annexure P-1), passed by learned Additional Civil Judge (Senior Division), Kapurthala, whereby the objections filed by the petitioner in execution proceedings, have been dismissed.

Learned counsel for the petitioner would contend that the suit for possession by way of specific performance of the agreement to sell dated 09.12.2009 with regard to the suit property, measuring 16 marlas, was decreed vide judgment and decree dated 08.11.2019, passed by learned Additional Civil Judge (Senior Division)-!!, Kapurthala. Aggrieved by the same, the petitioner challenged the aforesaid order by way of an appeal before the first appellate Court. The appeal was instituted on 13.12.2019. Along with the said appeal, an application under Order 41 Rule 5 CPC has also been filed, which is pending along with the main appeal and the next date of hearing before the first appellate Court is 11.08.2025.
