JUDGMENT :

Sudhir Agarwal, J.

1. Called in revise. None appeared on behalf of parties. In the circumstances, I myself have perused the record.

2. From the record it appears that petitioner has been dismissed from service vide order dated 02.08.2000 passed by Chairman, District Co-operative Bank Ltd. Fatehpur, pursuant to approval granted vide letter dated 01.8.2000 by U.P. Co-operative Institutional Service Board.

3. Record shows that charge sheet was issued to petitioner thereagainst he submitted reply vide letter dated 17.2.1995. Thereafter, Board of Directors gave opportunity to petitioner to place his defence and therein it has been claimed that petitioner has accepted the charge. Thereafter matter was referred to Institutional Service Board for approval and after receiving its approval, impugned order of punishment has been passed.

4. In para 8 of writ petition, it has been said that no oral inquiry was conducted by fixing date, time and place and no opportunity was given in accordance with rules. This is also evident from impugned order of punishment passed by disciplinary authority. Contents of para 8 of writ petition have been replied in para 8 of counter affidavit which reads a
