JUDGMENT :
1. Heard Mr. K. Shahi, learned counsel for the petitioner, Mr. Rakesh Pandey, learned Senior Advocate assisted by Mr. Ashutosh Mishra, learned counsel for respondent no.5, Mr. Akhilesh Chandra Srivastava, learned counsel for respondent no.4 and Mr. S.C. Upadhyay, learned Counsel for the State-respondents.
2. By means of the present writ petition, petitioner has assailed the order dated 7th January, 2022 passed by the Additional Director of Education (Basic), Shiksha Nideshalaya, Prayagraj i.e. respondent no.3 (Annexure-7 to the writ petition), whereby the petitioner has been transferred from District Kanpur Nagar to Sambhal. The petitioner has also prayed for a direction upon the respondents to permit the petitioner to work as Block Development Officer, Block Kalyanpur,District Kanpur Nagar.
3. It is the case of the petitioner that pursuant to the selection made by the U.P. Public Service Commission dated 31st March, 1998, petitioner was selected and appointed on the post of Assistant Basic Education Officer under the handicapped category as he is having 40% of locomotor disability.
