1. Heard Mr. Sri Nath Dwivedi, learned counsel for the appellant and Sri Rahul Asthana, learned A.G.A.-I for the State and perused the record.

The above noted appeal has been filed against the judgment of conviction and order of sentence dated 01.06.1983 passed by Vth Additional Sessions Judge, Kanpur in Sessions Trial No. 391 of 1982, wherein, the Trial Court has convicted the accused-appellant under Section 302 I.P.C. for life imprisonment under Section 364 I.P.C. for seven years rigorous imprisonment and under Section 201 I.P.C. for five years rigorous imprisonmen
