The death sentence reference and criminal appeal, mentioned hereinabove, have arisen out of the judgment and order of conviction and sentence, dated 19.11.2012 and 20.11.2012 respectively, passed by learned Sessions Judge, South Tripura, Udaipur in Sessions Trial Case No. S.T.68(ST/S)/2010, whereby the accused appellant Arjun Biswas has been found guilty of committing offence punishable under Section 302 of IPC and sentenced him to death.
The reference for confirmation of sentence of death has been made by the learned Sessions Judge under Section 366(1) of Cr.P.C. and the appeal has been preferred by the convict-accused from jail against the judgment and order of conviction and sentence under Section 374 of Cr.P.C.
