ORDER

The challenge in this Crl.M.C is against Annexure III order of the Special Court for Scheduled Caste/Scheduled Tribe (PoA) Act Cases, Kottarakkara, by which it was decided to proceed against the petitioner for the offences under Sections 3 23, 294(b), 506(i) of IPC and (1)(s) and 3(1)(r) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 ['the SC/ST (PoA) Act' for short]. The order is passed on a complaint filed by the 2nd respondent raising the following allegations;

The complainant was working as a Sales officer in the company owned by the 1st accused/ petitioner. Alleging that the complainant had misappropriated the company's money, by not remitting the amounts received from the shops to which hardware items were supplied, on 04.01.2024 at 9 am the 1st accused snatched the complainant's mobile phone, bike key and Aadhar card when he reached the office.
