Swarana Kanta Sharma, J. This judgment shall govern the disposal of Crl.Rev.P. 772/2018 and Crl.Rev.P. 565/2019, along with pending applications. Since both the petitions arise out of same set of facts and contentions and the issue before this Court in both the petitions is also common, the same are being decided through this common judgment. The petitioner in Crl.Rev.P. 772/2018 is the `State` whereas petitioner in Crl.Rev.P. 565/2019 is the `prosecutrix/complainant`.

The aforesaid revision petitions filed under Section 397 read with Section 401 of the Code of Criminal Procedure, 1973 (hereinafter referred to as `Cr.P.C') assail the order dated 14.06.2018 passed by learned Additional Sessions Judge/SFTC-2(Central), Tis Hazari Courts, Delhi (hereinafter referred to as `Trial Court') in case FIR bearing no. 475/2017

The court established that consensual relationships, even if based on promises of marriage, do not amount to rape unless there is clear evidence of deception or coercion, and the standard for proceed....
Consent obtained under false promises of marriage vitiates consent and constitutes a basis for rape charges under Section 375 IPC.
Consent in intimate relationships cannot be retrospectively withdrawn; criminal law should protect, not punish based on failed relationships.
Consent under Section 375 IPC can be vitiated by a false promise of marriage only if it is proven that such promise was made without any intention to fulfill it at the time of the promise.
Consent induced by false representation can vitiate the sexual act, even if the prosecutrix knew the accused was married.
