Substantial questions of law which are framed by the appellant herein read as under :- Whether in the absence of any proof of income or employment the Commissioner is legally entitled to award a higher compensation than the compensation claimed ? As per the direction of the High Court, the plaintiff has filed a complaint before the Banking Ombudsman on 24.07.2000 itself and the Banking Ombudsman has passed an award on 19.08.2000 and found that there was deficiency in service of the first defendant bank. The said writ petition was disposed of vide order dated 05.07.2000 permitting the petitioner therein to file a complaint before the Banking Ombudsman.
The Section, on the other hand, makes it plain that under no circumstance the award made by the Court should be less than the amount awarded by the Collector. Significantly the Section remains untrammelled by any conditions enjoining the making of a claim higher than what was sought for before the LAO. By implication it means that the Court can award higher compensation than what was awarded by the LAO. In other words the Section does not forge a connecting link between the claim made before the LAO and a claim made before the Court.
The Commission is aware that without delegation of power under Section 97 to the Ombudsman by it, the Ombudsman will not be empowered to grant compensation or penalty. Similarly by Regulation 56 of 2013 powers of the Commission has been delegated to the Ombudsman under Section 97 by the Commission to award compensation and penalty. This has also been accepted by the Commission as by special order dated 13th June, 2013 powers of the Commission under Section 57(3), 57(2) and 43(3) have been delegated to the Ombudsman under Section 97 of the 2003 Act.

By implication it means that the court can award higher compensation than what was awarded by the LAO. The only limitation on the power of the court in compensation appears to that the court cannot award a compensation less than the one awarded by the LAO.
