2006 4 Supreme 131 : The limitation of a conditional easement is determined solely by the terms of the grant between the parties. If the terms of the grant restrict the user of the easement subject to any condition, the parties are governed by those conditions. The scope of an easement by grant, including a conditional one, is controlled only by the contractual terms agreed upon by the parties, and such an easement does not get extinguished under Section 41 of the Indian Easement Act, 1882, which applies only to easements of necessity.
