The Tamil Nadu Open Places (Prevention of Disfigurement) Act, 1959, primarily aims to regulate and prevent unauthorized visual disfigurement of public spaces through advertisements and posters. Its provisions prescribe strict penalties, but judicial interpretation underscores the importance of procedural compliance, especially concerning limitation periods under Cr.P.C. — typically one year for cognizance and final reports. Courts have consistently quashed proceedings where these procedural timelines are exceeded or where complaints lack proper authority, emphasizing the need for strict adherence to the Act's definitions and procedural safeguards.
