Recognition of Degrees - Degrees obtained without recognition from the University Grants Commission (UGC) or from unrecognized institutions are generally considered invalid for government employment or appointments ["Pramod Kumar VS U. P. Secondary Education Services Commission - Supreme Court"], ["SHASHI KUMAR DWIVEDI VS STATE OF U. P. - Allahabad"], ["C. Senthamarai VS Registrar, University of Madras, Chennai - Madras"], ["C. Senthamarai VS Registrar University of Madras - Madras"], ["THE PRINCIPAL SECRETARY TO GOVERNMENT vs A.BALASARASWATHY - Madras"].
Validity of Open University Degrees - Degrees from open universities are recognized if they meet the minimum standards prescribed by the UGC. However, degrees obtained without following the prescribed pattern (e.g., not passing +2 or equivalent) are deemed invalid for public employment or academic purposes ["C. Senthamarai VS Registrar, University of Madras, Chennai - Madras"], ["C. Senthamarai VS Registrar University of Madras - Madras"], ["THE PRINCIPAL SECRETARY TO GOVERNMENT vs A.BALASARASWATHY - Madras"].
Recognition and Regulation by UGC - The UGC has the authority to specify standards for degree conferral, and only degrees granted by recognized universities or deemed universities with prior approval are valid for employment and promotion ["DHANDHALA BHARATKUMAR RANCHODBHAI vs STATE OF GUJARAT - Gujarat"], ["Chandrakant Vir Chakra VS Acting Principal M. L. N. Medical College, Allahabad - Allahabad"], ["Aminuddin Khan VS State of Rajasthan - Rajasthan"].
Degrees from Unrecognized Institutions - Degrees from institutions not recognized or approved by the UGC or not authorized under applicable laws are considered invalid for employment or promotion, and appointments based on such degrees are illegal ["DHANDHALA BHARATKUMAR RANCHODBHAI vs STATE OF GUJARAT - Gujarat"], ["Andhra Pradesh Public Service Commission, Hyderabad VS N. Praveena Naidu - Andhra Pradesh"], ["C. Senthamarai VS Registrar, University of Madras, Chennai - Madras"].
Appointment and Termination - If a candidate obtained a degree from an unrecognized university or through a non-recognized course, their appointment is invalid, and termination is legally justified once the recognition deficiency is established ["DHANDHALA BHARATKUMAR RANCHODBHAI vs STATE OF GUJARAT - Gujarat"], ["Andhra Pradesh Public Service Commission, Hyderabad VS N. Praveena Naidu - Andhra Pradesh"].
Relaxation and Exceptions - The UGC can grant relaxation or exemptions in specific cases; however, such relaxations do not extend recognition to degrees obtained without compliance with prescribed standards ["DHANDHALA BHARATKUMAR RANCHODBHAI vs STATE OF GUJARAT - Gujarat"], ["Andhra Pradesh Public Service Commission, Hyderabad VS N. Praveena Naidu - Andhra Pradesh"].
Analysis and Conclusion:Based on the provided sources, students who obtained degrees without recognition from the UGC or from unrecognized institutions do not have valid qualifications for government jobs or appointments. If the university or institution was not recognized or approved by the UGC at the time of degree conferral, the appointment based on such a degree is considered illegal and can be terminated. The right approach is to ensure that degrees are obtained from recognized universities following prescribed standards; otherwise, such degrees are invalid for employment purposes. Therefore, at this stage, appointment or termination decisions should be aligned with the recognition status of the degree and the applicable regulations.
In today's competitive job market, securing a government position is a significant achievement. But what if the degree that got you there is from a university not recognized by the University Grants Commission (UGC)? A common query arises: Students studied, obtained degree without recognition from University Grants Commission, later appointed to state government job. At this stage, is the appointment termination right thing?
This scenario raises critical legal questions about qualification validity, employment eligibility, and the consequences of post-appointment discoveries. While individual cases vary, courts have consistently ruled that such appointments are typically invalid, justifying termination to protect public interest and educational standards. This post explores the legal framework, key precedents, and practical advice—remember, this is general information, not specific legal advice. Consult a qualified lawyer for your situation.
Appointments to state government jobs based on degrees from institutions lacking UGC recognition are generally considered invalid. These degrees do not hold legal equivalence for employment purposes. Termination in such cases is legally justified to uphold minimum educational standards and serve the public interest. Unrecognized qualifications fail to meet eligibility criteria for public service roles. B. N. Devadas VS University Grants Commission, rep. by its Secretary, Bahadurshah Zafar Marg & Others - 2009 0 Supreme(Mad) 1710
State governments and courts prioritize standards set by UGC, National Council for Teacher Education (NCTE), All India Council for Technical Education (AICTE), and similar bodies. Even if the degree was obtained before appointment, discovery of its invalidity post-hiring warrants termination without infringing on vested rights. Public interest in maintaining quality—especially in teaching or technical roles—overrides individual claims. No regularization is possible for statutory violations. State of U. P. VS Bhupendra Nath Tripathi - 2010 8 Supreme 690
The UGC Act is central here. Section 22 restricts degree conferment to recognized universities, stressing: Mere conferment of degree is not enough. What is necessary is that the degree should be recognized.B. N. Devadas VS University Grants Commission, rep. by its Secretary, Bahadurshah Zafar Marg & Others - 2009 0 Supreme(Mad) 1710 Institutions without UGC/Distance Education Council (DEC) approval cannot award valid qualifications. Government of Tamil Nadu, Rep. by its Secretary VS D. S. Ananthalakshmi - 2021 0 Supreme(Mad) 1768
Related rulings reinforce this. In one case, an M.A. degree from an Open University without a preceding first degree violated UGC Regulations, rendering a Principal's appointment illegal. The court directed refilling the post lawfully. N. Ramesh & Others VS Sibi Madan Gabriel & Others - 2008 Supreme(Mad) 385 Similarly, M.A. degrees from open universities bypassing the 10+2+3+2 pattern were deemed invalid for public appointments or promotions. Principal Secretary to Government, Personnel and Administrative Reforms Department VS A. Balasaraswathy - 2024 Supreme(Mad) 1811

Degrees from non-UGC recognized universities generally invalidate state government appointments, making termination legally sound. Courts prioritize standards and public welfare, as seen in numerous precedents. Always verify credentials upfront to avoid heartache.
Key Takeaways:- UGC recognition is non-negotiable for public jobs.- Post-hiring invalidity leads to termination without regularization.- Public interest overrides equity claims.

Hence until and unless the Madras University grants affiliation to the writ petitioner institution, it had no right at all to admit students which would lead to conferring a degree of Madras University. Admittedly, the degree (B.Ed.), which is sought to be conferred on the students, will be that of the Madras University. If admissions are granted, even though the college has not got affiliation, then if ultimately the affiliation is refused, the students will be left in the lurch having wasted lot of time and money.”
8. The power of pharmacy council to grant registration and refuse registration is not in dispute. At the same stroke pharmacy council is under obligation to register or grant registration once the students have completed/obtained their requisite diploma/degree/certificate from the recognized university/board. There is no question of denying the same, once they are qualified and eligible to get registration under the provisions of the Act and regulations made thereunder.
