( 1 ) THIS Civil Miscellaneous Appeal and the Civil Revision Petition filed by the State of Andhra Pradesh and its officials of the Irrigation Department arise out of an arbitration matter. The C. M. A. is against O. P. 132 of 92 on the file of the Additional Subordinate Judge, Ongole under Section 30 of the arbitration Act to set aside the award dated 17-9-1992 passed by the Arbitrator. The C. R. P. is against O. S. No. 4 of 93 on the file of the same Court filed by the contractor/respondent under Sections 14 and 17 of the Arbitration Act to make the award dated 1/-9-1992 rule of the Court. By a common judgment dated 1/-1-1994, the lower Court dismissed O. P. No. 132 of 92 and decreed o. S. No. 4 of 93 making the award rule of the Court for a sum of rs. 2,73,025/- with subsequent interest at 6% per annum on Rs. 1,06,390/- from the date of decree till realisation and for costs of Rs. 7,790/ -.

( 2 ) THE State entered into an agreement with the respondent on 1-5-1983 for the construction of a vented causeway on Inagaleru Drain. The value of the work was estimated at Rs. 1,07,057/ -. The work site was handed over to the respondent on 8-5-1983. The time stipulated
