IMPORTANT POINT
Immoral Traffic (Prevention) Act, 1956 do not prohibit sale of sexual services per se – There is no specific provision under Act, 1956, that is directed towards customers.

Headnote:

Immoral Traffic (Prevention) Act, 1956 – Sections 3, 4 and 5 – Indian Penal Code, 1860 – Section 370A – Criminal Procedure Code, 1973 – Section 482 – Prostitution – As per statements of victims recorded under Section 161 of Cr.P.C., due to poverty and other family backgrounds, victims have voluntarily joined organization of brothel house – At the stage of filing of FIRs, Police Agency could not prove that customers have knowledge and/or reason to believe that women were trafficked for the purpose of prostitution – Act, 1956 does not prohibit sale of sexual services per se – There is no specific provision under Act, 1956, that is directed towards customers – Customers may file application either for grant of anticipatory bail or for grant of bail along with a petition to quash criminal proceedings initiated against them – There was no proof of any exchange of money – In absence of any material that women are trafficked for the purpose of engaging for sexual exploitation, offence under Section 370 (A)(2) of I.P.C. will not attract against customers – Criminal proceedings quashed. (Paras 14, 17, 18, 20, 26 and 41)

Result: Criminal Petitions allowed.
