ORDER

This Complaint has been filed by 30 Complainants for the following reliefs:—

(i) Direct the Opposite Parties to refund the amount received in lieu of extra area i.e. difference in the area of the Flats with 18% rate of interest.

(ii) Direct the Opposite Party to pay the Complainants for the delay in completion of the construction and handing over the possession of flats till actual delivery of possession with 18% rate of interest.

(iii) Direct payment of amount of Rs.10,00,000/- (Ten Lakhs Only) towards compensation / damages for mental agony and harassment, having caused deficiency in the services rendered, legal notice charges and misc. expenses to each Flat Buyers.

(iv) Impose penalty exemplary costs on Opposite Parties for not the BBA payable to the complainants.

(v) Direct the concerned authority to demolish illegal floors constructed in the project which in not approved / sanctioned.

(vi) Impose penalty for selling illegal shops constructed in the said premises.

(vii) To pass any other order or direction which the Hon’ble Commission may deem fit and pro
