JUDGMENT :

Mohammad Rafiq, J.

1. This judgment will decide two appeals, both of which seek to challenge the judgment dated 22.05.2018 by which the writ petition filed by the respondent-writ-petitioner M/s. Ramky Infrastructure Ltd. (for short, 'the writ-petitioner'), has been allowed holding the action of the appellant - Rajasthan Urban Infrastructure Development Project (for short, 'the appellant-RUIDP') in declaring the technical bid of the writ-petitioner as non-responsive, illegal and unjustified and directing the appellants to open the financial bid of the writ-petitioner and take a decision relating to award of contract.

2. Facts giving rise to these appeals are that the appellant-RUIDP in SAW No. 804/2018 floated a bid for procurement of design and construction of work of providing sewer network with house sewer connections, trench-less sewer, design and construction of sewage treatment plant, sewage pumping station, power generation unit at STP & allied works and operation & maintenance services of the entire system for 10 years in Kota City (Part Area). Last date for submission of the bid documents was 22.08.2017 and the date for submitting the original documents and opening
