JUDGMENT :
1. In all these writ petitions the vires of Rule 159 of the Jharkhand High Court Rules, 2001 has been challenged on the ground that they are ultra-vires to the provisions of Section 397 and 477 of the Code of Criminal Procedure Code, 1973.
2. Learned counsel for the petitioners and the State both submit that the very issue relating to requirement of surrender of the accused before filing of criminal revision application, as per Rule 159 of the Jharkhand High Court Rules, 2001 was considered and decided by the Hon’ble Supreme Court in the case of Vivek Rai and Another vs. High Court of Jharkhand through Registrar General and Others, (2015) 12 SCC 86. The Apex Court has inter alia held as under:

The court upheld the validity of Rule 159, emphasizing the importance of ensuring that a convicted person obeys the law and does not abscond.
A convicted individual must surrender before the court to maintain a revision under Sections 397 and 401 of the Criminal Procedure Code, as per the Allahabad High Court Rules.
Rule 48 of the M.P. High Court Rules mandates that a convicted person must surrender or be in custody to maintain a criminal revision petition, barring exceptions for suspended sentences.
A criminal revision must be accompanied by surrendering before the trial court to be maintainable, as established by Supreme Court precedent.
Surrender is mandatory for criminal revision applications under Rule 48 of Madhya Pradesh High Court Rules, and exemptions can only be granted in exceptional cases, supported by robust medical eviden....
The court emphasized the procedural propriety requiring litigants to first approach subordinate courts before the High Court unless exceptional circumstances justify bypassing this route.
