Prayer: Letters Patent Appeal filed under Clause 15 of Letters Patent Act, to set aside the order, dated 18.11.2014 made in Cont.P(MD)No. 394 of 2013 on the file of this Court insofar as the observation of the Hon'ble Single Judge regarding the registered sale deed, dated 18.01.2013 in Document No. 37/2013 as null and void is concerned.
1. Heard the learned counsel appearing for the appellant and the learned counsel appearing for the first respondent.
2. Though the facts of the case has a long and chequered history, for considering this LPA, the short point is whether the appellant who is a third party to the contempt proceedings, can suffer nullification of the sale deed in her favour, to be considered whether the same was passed following the principle of natural justice or not.
3. The subject matter is in respect of portion of the land measuring 2.82 ares in Korkai Village. The land in dispute originally held by Sundaresa Ramalingam and later devolved upon his 5 sons. A civil suit for partition between the sons of Sundaresa Ramalingam has been filed in O.S.
