JUDGMENT :
The defendants have filed this appeal against a confirming judgment. The suit filed by the plaintiff for eviction of the defendants from the suit house was decreed by the trial court and confirmed by the 1st Appellate Court.
3. The plaintiff’s case, briefly stated is that he is the son of late Bhabanipati Ghose and has three married sisters. The sisters have relinquished their right over their land appertaining to Hal Plot No.274 under Hal Khata No.135 of Golapbag in Baripada town measuring Ac.0.08 decimals in favour of the plaintiff. A house situates in the north-west side of the land over an area measuring Ac.0.02 decimals and 500 square links. The suit house is said to be in a dilapidated condition. A co-sharer can file an eviction suit against tenants without including other co-sharers, and valid notice under Section 106 of the Transfer of Property Act suffices for eviction.
Proper description of suit property is essential for maintainability; mis-description leads to dismissal.
A suit for eviction cannot be dismissed solely due to misdescription if the property can be identified by boundaries or numbers.
A tenant cannot contest landlord rights while occupying property, and eviction actions can proceed without the property owner as a party.
Possession based on unregistered sale agreements does not confer legal rights, making occupants liable for eviction despite their claims of tenancy.
In property title suits, all co-owners must be included as parties and specific property boundaries must be identifiable, or the suit is invalid.
The landlord's bona fide requirement for eviction must be assessed based on their own needs, and one co-owner can initiate eviction proceedings without consent from others.
